1. Acceptance and scope
These Terms of Service and End User Licence Agreement (the "Terms") form a binding legal agreement between the Fur IQ entity that provides the Services to you ("Fur IQ", "we", "us" or "our") and each person or entity that accesses or uses our websites, mobile applications, software, communities, chats, booking and payment tools, marketplace, AI features, content tools, APIs, forms, events, advertising tools and related services (collectively, the "Services").
By creating an account, accepting these Terms, clicking an acceptance button, accessing the Services, downloading our app, uploading content, using a customer portal created by a business user, or otherwise using any part of the Services, you agree to be bound by these Terms and our Privacy Policy, Cookie Notice, Community Standards, payment terms, promotional terms and any other policies or feature-specific terms we make available and state are incorporated into these Terms.
If you use the Services on behalf of a company, partnership, trust, sole trader business, rescue organisation, club or other entity, you represent and warrant that you have authority to bind that entity. In that case, "you" includes both you individually and the relevant entity.
If you do not agree to these Terms, you must not use the Services.
If you are under 18 years old, these Terms apply to your use together with the approval and responsibility of your parent or guardian, and where relevant your employer, business account owner, school, trainer, or other authorised supervising adult or entity.
2. Who may use the services
You must be at least 18 years old, or the age of majority in your jurisdiction if higher, to create or control an account in your own name as an independent user, business user, provider, advertiser or administrator, or to make payments, enter paid subscriptions, accept payouts, create chargeable listings, purchase advertising, or otherwise enter binding commercial transactions through the Services, except as expressly permitted below.
Individuals who are under 18 years old may access or use limited parts of the Services only with the involvement and approval of a parent or legal guardian, and where applicable a school, employer, business owner, or other responsible adult or entity authorised to supervise that use, to the extent permitted by applicable law.
A person under 18 years old may only start, operate, manage, or hold themselves out as running a business through the Services with the approval of their parent or legal guardian and any other authority required by applicable law.
You must not use the Services if you are prohibited from receiving the Services under applicable law, have previously been suspended or removed by Fur IQ for serious or repeated violations, or are located in a jurisdiction where providing the Services would be unlawful.
3. Account types and administrators
The person or entity that creates or controls a business account is the account owner or administrator. The administrator is responsible for configuring permissions, managing staff access, maintaining accurate business information, ensuring lawful use of customer data within the business environment, and paying all applicable subscription fees, transaction fees and charges.
If you access the Services through an account created for you by a business, provider, team leader or other administrator, that person or entity may control aspects of your account, including access permissions, data visibility, integrations, communications settings and whether your account remains active.
You must provide accurate, current and complete account information and keep it updated. You are responsible for all activity under your account and for maintaining the confidentiality and security of your credentials. Notify us immediately if you suspect unauthorised access or misuse.
4. Software licence and acceptable use
Subject to these Terms, Fur IQ grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable licence to access and use the Services and, where applicable, to install and use our apps on devices you own or control, solely for your internal business use or personal use in connection with the Services.
You must not, and must not permit any other person to: (a) copy, modify, adapt, translate, reverse engineer, decompile or disassemble the Services except to the extent a restriction is prohibited by law; (b) rent, lease, resell, white-label, distribute, sublicense, bureau or timeshare the Services except as expressly authorised by us in writing; (c) access the Services to build a competing product or service; (d) interfere with security, integrity, availability or performance; (e) scrape, harvest, extract or systematically collect data except through authorised tools; (f) circumvent feature limits, fees, security or access controls; (g) upload malicious code, spam or unlawful content; or (h) use the Services in a way that infringes any person's rights or violates law.
We may suspend, throttle, limit or disable access to preserve platform integrity, enforce our policies, comply with law, mitigate risk or protect users, pets, staff, systems or third parties.
5. User content, social features and communications
The Services allow you and others to create, upload, submit, post, stream, send, store, publish and share content, including text, forms, checklists, ratings, reviews, business information, pricing, images, videos, pet profiles, pet photos, comments, chat messages, community posts, event information, AI prompts and outputs, and other material ("User Content"). You retain ownership of your User Content subject to the rights you grant under these Terms.
You grant Fur IQ a worldwide, non-exclusive, royalty-free, transferable, sublicensable licence to host, store, reproduce, adapt, modify, translate, format, publish, display, perform, distribute and otherwise use your User Content as reasonably necessary to operate, improve, secure, market, personalise and provide the Services, including to create backups, thumbnails, previews, feeds, search results, safety reviews, moderation records and aggregated or de-identified insights. This licence continues for as long as the User Content is stored or reasonably needed for the Services, legal compliance or dispute resolution.
You must not post, upload, message, transmit or otherwise make available any User Content that is unlawful, defamatory, fraudulent, misleading, harassing, abusive, hateful, sexually exploitative, violent, infringing, invasive of privacy, harmful to animals, or otherwise prohibited by our policies. We may remove, restrict, demonetise, down-rank, label or disable access to any User Content at any time.
6. AI, pet recognition and automated tools
The Services may include artificial intelligence, machine learning, recommendation, ranking, recognition, editing, summarisation, automation or other model-driven features, including pet recognition, content generation, transcription, editing assistance, moderation assistance, customer communications automation, business analytics, benchmarking, pricing tools, recommendations and ad targeting tools (collectively, "AI Features").
AI Features may generate outputs, suggestions, identifications, classifications, rankings, captions, edits, summaries, business insights, operational prompts, pricing recommendations or other content ("AI Output"). AI Output is generated automatically and may be incomplete, inaccurate, offensive, biased or unsuitable for your use case. You are responsible for reviewing AI Output and exercising your own judgment before relying on it.
Fur IQ does not warrant that any AI Feature will correctly identify an animal, person, breed, service issue, safety issue, legal requirement, pricing result, customer propensity, purchasing trend or any other matter. AI Features are assistive tools only and are not legal, medical, veterinary, accounting, tax, insurance, employment or other professional advice.
You must not use AI Features to generate unlawful content, deceptive advertising, impersonation, harmful instructions, discriminatory outcomes, spam, harassment, or content that violates any person's rights. We may impose usage limits, prompt restrictions, safety controls, watermarking, moderation or audit logging on AI Features.
7. Marketplace, bookings and offline services
Fur IQ provides a platform through which businesses, providers, pet owners, customers and other users may discover one another, communicate, advertise, build profiles, list or request services, submit enquiries, create or accept bookings, process payments and manage related workflows. Except where Fur IQ expressly states otherwise for a specific product, Fur IQ is not the direct provider of offline pet care, grooming, boarding, training, transport, walking, sitting, daycare, veterinary, rescue, breeding, retail or other services arranged through the Services.
Any booking, appointment, engagement, enquiry, quote, service order, proposal, event ticket, membership, add-on, subscription sold by a business user, or other transaction between users is between the relevant users. Fur IQ is not a party to the underlying offline service contract between a business or provider and its customer unless Fur IQ expressly states otherwise for a particular offering.
We do not guarantee the conduct, quality, legality, suitability, safety, availability, pricing, timeliness or outcome of any user, pet, provider, customer, service, listing, chat, event or transaction. Interactions with other users, pets and third parties are at your own risk.
8. Payments, subscriptions and taxes
Certain features require payment of subscription fees, platform fees, booking fees, transaction fees, advertising fees, payout processing fees or other charges. You agree to pay all fees, charges and taxes described in your order form, pricing page, billing settings, plan summary, booking flow or other applicable commercial terms.
Unless stated otherwise, fees are quoted exclusive of taxes, duties or levies. You are responsible for all taxes associated with your use of the Services or your sale or purchase of goods or services through the Services, other than taxes based on Fur IQ's net income.
Where the Services facilitate payment collection, payouts or billing, Fur IQ may use third-party payment processors and may act as a limited collection agent for the sole purpose of accepting and remitting funds.
Subscriptions renew automatically for successive billing periods unless cancelled before renewal in accordance with the applicable plan terms. Except where required by law or expressly stated otherwise, fees are non-refundable once billed.
9. Third-party services and app stores
The Services may integrate with or rely on third-party products and services, including payment processors, messaging providers, maps, social platforms, ad networks, cloud providers, app stores, analytics providers, identity verification services, calendar tools, accounting systems, point-of-sale tools, e-commerce channels and AI model providers. Your use of third-party services may be subject to separate terms between you and the relevant third party.
Fur IQ is not responsible for third-party products or services, including their availability, accuracy, security, legality or performance. We may enable integrations as a convenience and may add, remove, suspend or modify integrations at any time.
If you download our app from the Apple App Store, Google Play or another app marketplace, you acknowledge that these Terms are between you and Fur IQ, not the app store operator, and that the app store operator has no obligation to furnish maintenance or support.
10. Safety, compliance and community standards
You must follow our Community Standards, marketplace policies, advertising rules, moderation rules, safety guidance, AI usage rules, animal welfare rules and any feature-specific restrictions we publish from time to time.
Without limiting any other restriction, you must not use the Services to: (a) facilitate unlawful conduct or prohibited goods or services; (b) abuse, neglect or endanger animals or people; (c) impersonate another person or misrepresent affiliation, qualifications or identity; (d) send spam, chain messages or unauthorised commercial communications; (e) manipulate reviews, rankings, engagement or advertising metrics; (f) stalk, threaten, extort or harass others; (g) infringe intellectual property, privacy, publicity or confidentiality rights; (h) collect or process personal data without lawful authority; or (i) bypass safety, moderation, age-gating or consent mechanisms.
We may investigate violations, cooperate with authorities, preserve records, report unlawful conduct, and take any action we reasonably consider appropriate, including warnings, content removal, payout holds, account limitations, age checks, referral to insurers or regulators, suspension or termination.
11. Intellectual property and feedback
Fur IQ and its licensors own the Services, including the software, code, models, interfaces, designs, text, graphics, logos, workflows, databases, compilations, look and feel and all related intellectual property rights, excluding User Content. Except for the limited licence expressly granted in these Terms, no rights are granted to you.
You must not use Fur IQ's name, logos, trade dress, screenshots or brand assets except as permitted by our brand guidelines or with our prior written consent.
If you provide suggestions, ideas, feedback, bug reports, enhancement requests, prompts, workflow ideas, product comments or similar materials regarding the Services ("Feedback"), you grant Fur IQ a perpetual, irrevocable, worldwide, royalty-free right to use, modify, commercialise and exploit that Feedback without restriction or payment to you.
12. Disclaimers, liability and indemnities
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE". FUR IQ DISCLAIMS ALL WARRANTIES, REPRESENTATIONS AND CONDITIONS, WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, QUIET ENJOYMENT, AVAILABILITY, UPTIME, SECURITY, ACCURACY, RELIABILITY, COMPATIBILITY OR THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE OR SUITABLE FOR YOUR NEEDS.
Fur IQ does not provide insurance, bonding, guaranteed recovery, veterinary cover, pet care guarantees, service guarantees, or protection plans unless Fur IQ expressly states otherwise in a separate written product notice or policy.
To the maximum extent permitted by law, Fur IQ will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, goodwill, data, business opportunity, anticipated savings, contracts or reputation, even if advised of the possibility of those damages.
To the maximum extent permitted by law, Fur IQ's aggregate liability arising out of or relating to the Services or these Terms will not exceed the greater of: (a) the amounts paid by you to Fur IQ for the Services in the 12 months before the event giving rise to the claim; and (b) AUD $100.
You indemnify and hold harmless Fur IQ, its affiliates, personnel, licensors, service providers and partners from and against any claims, losses, liabilities, damages, judgments, costs and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Services; (b) your User Content; (c) your business, listings, ads, bookings, offline services or dealings with customers, providers or pets; (d) your breach of these Terms or law; or (e) your infringement or violation of any person's rights.
13. Suspension, termination and service changes
You may stop using the Services at any time. If you wish to terminate a paid subscription, you must follow the cancellation process for your plan. Cancellation does not relieve you of fees already incurred, and certain obligations survive termination.
We may suspend or terminate your access, delete or disable content, remove listings, withhold payouts where permitted, or discontinue any part of the Services at any time if we reasonably believe: you breached these Terms or our policies; your use creates risk or potential legal exposure; we must do so to comply with law or a request from authorities; your account is inactive for an extended period; or it is otherwise necessary to protect Fur IQ, users, pets, staff, systems or third parties.
We may modify, replace, discontinue or impose limits on any feature, content, marketplace surface, messaging capability, AI Feature, integration, API or pricing plan at any time. We are not liable for changes to the Services, provided that nothing in these Terms excludes rights that cannot lawfully be excluded.
14. Dispute resolution, governing law and general terms
These Terms, and any non-contractual disputes arising out of or in connection with them, are governed by the laws of New South Wales, Australia, excluding conflict of laws rules.
Before commencing any formal proceeding, the parties must follow an escalation pathway: first, written notice describing the dispute; then good faith efforts to resolve through internal dispute resolution within 20 business days; then confidential mediation administered in Sydney, New South Wales; and finally, if unresolved within 30 days after appointment of the mediator, binding arbitration administered by the Australian Centre for International Commercial Arbitration (ACICA).
If any provision of these Terms is held unenforceable, that provision will be interpreted to reflect the parties' intent as closely as possible and the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign or transfer these Terms without our prior written consent.
These Terms constitute the entire agreement between you and Fur IQ regarding the Services except for any written enterprise order form or other signed agreement that expressly supersedes them in part.
Schedule A — Additional business user terms
If you are a business user, provider or organisation that uses the Services to manage customers, staff, bookings, forms, communications, payments or content, you are responsible for: (a) obtaining all notices, rights and consents required for your collection, upload, use and disclosure of customer, pet, staff and household data; (b) configuring user permissions appropriately; (c) maintaining your own service agreements, cancellation policies, emergency instructions and legal compliance documents where required; and (d) ensuring that your staff and contractors are trained and authorised to use the Services.
You appoint Fur IQ as your service provider or processor, as applicable under relevant privacy laws, only to the extent Fur IQ processes personal information on your behalf in providing the Services.
Business users are solely responsible for the substance and legality of their forms, agreements, intake fields, cancellation policies, waivers, marketing claims, prices, invoices, memberships, packages, subscriptions, service descriptions and customer communications created or sent through the Services.
Schedule B — Consumer and pet owner acknowledgements
If you are a pet owner, customer or consumer using the Services to discover, contact or book with a provider or business, you acknowledge that Fur IQ is not the provider of the offline services you book unless explicitly stated otherwise. You are responsible for reviewing provider profiles, disclosures, cancellation terms, pricing, credentials and suitability.
If you are under 18 years old, you may use the Services only with the approvals and supervision required by Section 2. Any payments, paid bookings, subscriptions, advertising purchases, or other binding commercial commitments must be made by your parent, guardian, or another legally responsible adult or entity unless applicable law permits otherwise and Fur IQ expressly allows it.
You must provide complete and accurate information about your pet, household, property access, health issues, medications, behavioural issues, vaccination status, bite history, aggression triggers, special handling needs, and any other safety-relevant facts. Failure to disclose relevant information may affect bookings, refunds, insurance coverage, safety outcomes and your legal rights against a provider or third party.
Emergency, veterinary and care decisions relating to your pet remain your responsibility unless you separately authorise a provider to act in emergencies under your service agreement or booking terms.

Legal notices, support requests and privacy-related notices under these Terms should be sent to Fur IQ at contact@furiq.io. You are responsible for ensuring that your contact details remain current so that you can receive notices from us.
We may send notices to you through the Services, by email, SMS, push notification, dashboard message or by posting on our website or app, and those notices will be effective when sent or posted unless mandatory law requires otherwise.
